1.1 Please read these terms and conditions carefully before using the web site operated by the British Healthcare Business Intelligence Association ('BHBIA' 'we' or 'us'). By accessing or using the BHBIA web site, the address of which is www.bhbia.org.uk, ('our web site') you agree to be legally bound by these terms and conditions as they may be modified and posted on our web site from time to time.
1.2 If you do not wish to be bound by these terms and conditions then you may not use our web site.
1.3 BHBIA reserves the right to amend these terms at any time. Please check for updates from time to time. We may withdraw this website and withdraw or change any of our services at any time.
1.4 Our web site is controlled and operated by us from our offices at St James House, Vicar Lane, Sheffield, S1 2EX and it is designed, produced and managed for us by HMA Digital Marketing.
2. Nature of our web site
2.1 Our web site is a place for you to view the information contained and to select and order various Services including membership/certified non-membership subscriptions and places at paid-for training courses/events or free webinars (webinars available to full BHBIA members only), and to undertake online training/certification (available free of charge to subscribed members/certified non-members).
2.2 Our web site describes each of the Services in more detail.
2.3 Whilst we have taken care to ensure the accuracy of this site and its content, BHBIA accepts no liability for any damage, costs, injury or financial loss of any kind incurred as a result of reliance on the information or opinions within this site.
3. Buying Services on our web site
3.1 To order a Service on line, you will need to follow the ordering procedure set out on the relevant order page.
3.2 Details of our prices for the Services, and the procedures for payment and delivery are displayed on the relevant page of our web site. The price of any Service is the price in force at the date and time of your order.
3.3 BHBIA is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means to the email address you have given us on ordering and by sending an invoice to the postal address or email you have given us on ordering.
3.4 You undertake that all details you provide to us for the purpose of purchasing Services will be correct.
3.5 The cancellation policy for training course/event bookings is stated on the relevant page of our web site. If you cancel within the specified timelines we will refund any payment made by you.
3.6 If you have any complaints you should direct them to us via email at admin@bhbia.org.uk, or by post at St James House, Vicar Lane, Sheffield, S1 2EX.
4. Modifications to web site
4.1 We reserve the right to alter, suspend or discontinue any aspect of our web site or the content or services available through it, including your access to it. Unless explicitly stated any new features including new content, and/or the sale of new Services shall be subject to these terms and conditions.
5. Modifications to Events, Training Courses, Webinars or Online Training
5.1 We reserve the right to alter any of these with respect to programme content, speakers, timing or location.
6. Information you provide
6.1 The following applies to any information you provide to us; for example, during any registration or ordering process:
6.1.1 you authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address ('Personal Information'), in accordance with our privacy policy;
6.1.2 you must ensure that the Personal Information you provide is accurate and complete and that all ordering or registration details (where applicable) contain your correct name, address and other requested details.
7. Applicability of Online Materials
7.1 We have used our best endeavours to ensure that our web site complies with UK law. However, we make no representations that the materials on our web site are appropriate or available for use in locations outside the United Kingdom.

8.1 The contents of our web site are protected by international copyright laws and other intellectual property rights. The owner of these rights is BHBIA or other third party licensors. All product and company names and logos mentioned in our web site are the trade marks, service marks or trading names of their respective owners including us. 9.1 BHBIA make no representations whatsoever about any other web sites which you may access through our web site or which may link to our web site.
9.2 When you access any other web site, you understand that it is independent from BHBIA and that we have no control over the content or availability of that web site.
9.3 A link to any other site does not mean that BHBIA endorses or accepts any responsibility for the content, or the use of, such a web site and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other web site or resource.
9.4 Any concerns regarding any external link should be directed to its web site administrator or web master.
10. Availability of our web site
10.1 We will try to make our web site available but cannot guarantee that our web site will operate continuously or without interruptions or be error free and can accept no liability for its unavailability.

11.3 In relation to the purchase of Services, we accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable.

You also understand that we cannot and do not guarantee or warrant that any material available for downloading from our web site will be free from infection, viruses and/or other code that has contaminating or destructive properties. 12.1 The BHBIA Web Site may contain bulletin board services, forums, news/features submission forms and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.
12.2 By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

12.3 BHBIA has no obligation to monitor the Communication Services. However, we reserve the right to review materials posted to a Communication Service and to remove any materials in our sole discretion, or to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
12.4 We reserve the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion.
12.5 Always use caution when giving out any personally identifying information in any Communication Service.
12.6 BHBIA does not control or endorse the content, messages or information found in any Communication Service and, therefore we disclaim any liability with regard to the Communication Services and any actions resulting from your participation in them. Views expressed via any Communication Service do not necessarily reflect those of the BHBIA or its directors.
12.7 Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.
12.8 BHBIA does not claim ownership of the materials you provide to us or post, upload, input or submit to the BHBIA Web Site or its associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting BHBIA permission to use your Submission including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission (unless specifically stated otherwise – e.g. the confidential sections of BOBI Awards submissions).
12.9 No compensation will be paid with respect to the use of your Submission, as provided herein. BHBIA is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in our sole discretion.
12.10 By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
13. General
13.1 We may assign, novate or subcontract any or all of our rights and obligations under these terms and conditions at any time.
13.2 We may alter these terms and conditions from time to time and post the new version on our web site, following which all use of our web site will be governed by that version. You must check the terms and conditions on the web site regularly.
13.3 These terms and conditions, together with the privacy policy, any order form and payment method instructions, if any, are the whole agreement between you and BHBIA. You acknowledge that you have not entered into this agreement in reliance upon any warranty or representation made by BHBIA or any other person and you waive any rights to damages/rescission you may have for misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions, privacy policy, order form and payment method instructions.
13.4 If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.
13.5 These terms and conditions and your use of our web site are governed by the law and you submit to the non-exclusive jurisdiction of the courts of England and Wales.
13.6 Neither you nor BHBIA will be held liable for any failure to perform any obligation to the other due to causes beyond your or BHBIA's respective reasonable control.
13.7 Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy.

We may directly collect analytics data, or use third-party analytics tools and services, to help us measure traffic and usage trends for the Service – see details
15. Notices
15.1 All notices shall be given:
15.1.1 to us via email at admin@bhbia.org.uk or via post at St James House, Vicar Lane, Sheffield, S1 2EX;
15.1.2 to you at either the email or postal address you provide during any membership application or ordering process. Notice will be deemed received when an email is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.
16. Replacement
These terms and conditions replace all other terms and conditions previously applicable to the use of our web site and/or sale of the Services.
